Watching live. She looks calm and proper. I am so proud of her as a woman.
So cool she is a Doctor. I never regretted not going for a phd until this moment. So nice to be addressed as Dr instead of Mrs or Ms.
Her voice breaks a little when she said she was terrified to be there.

Strange to say so but the female prosecutor Rachel Mitchell comes across as considerate and experienced, and she clearly treats Dr Ford with respect and as a potential victim - so far..

I spoke too soon. Rachel Mitchell is subtly trying to undermine her credibility by mentioning all the people that could have been at the party but no one came forward to collaborate her story. And by pointing out inconsistencies in her story. But still, in a respectful, professionally way without questioning her credibility directly. Smart.

This is so much more gripping than Bodyguard.

Depends what her job is. She could be
A: Hired by Judiciary Committee to establish how credible Dr Ford and Kavanaugh each is.
Or
B: Hired by Republican Senators in Judiciary Committee to defend Kavanaugh.


For the first few minutes I had the delusion it was A. Even if she sees her job as defending Kavanaugh, she is doing so sensitively, professionally and respectfully.

刚才看华人,有个投票,结果显示绝大部分人不相信Ford说的话,而且绝大部分人觉得这就不是什么大不了的事儿。
同时呢,很多华人共和党对自己identify 性别上厕所的事情深恶痛绝,尤其怕女孩子被性侵。那为啥会觉得Ford被Kavanaugh那么对待也不算个事儿呢?
不明白这个逻辑。

因为说到底这帮人的逻辑也不是建立在保护弱者上面,而是遵从丛林法则而已。他们都自动站队到“强者”那边,认为高富帅自动拥有一切,都是他们应得的不应该受什么约束。所以反对一切与此相违背的事件和趋势。保护既得利益者的权利高于一切。

这才是美国人民选出来的总统。
至少目前为止Kavanaugh还没有说这句,他跟克林顿一样,是一个比较普通的渣男。跟Trump相比还是有不小的距离。

说到底其实这些那些原因都是障眼法,根本不是主因。主因就是华人共和党跟班叔一样就是种族主义者和性别歧视者。
那些觉得这都不是大事儿的,问下他们/她们,如果是个有色人种男性这样对待一个白人女性呢?

查了一下,高庭法官也可以被impeach. 但是需要参议院三分之二赞同票。
希望选民够愤怒中期选举见分晓吧。。。

我一直觉得肯定会confirm的啊!共和党占多数嘛。这个hearing就是不得不做出来的,其他诸如什么FBI调查啦传唤证人了,都不做,对于共和党来说这就是一个小小羁绊,一个hiccup而已。

我看的时候都没意识到他是在假哭,觉得这人说话怎么习惯这么坏,老皱鼻子干嘛?看到后来发现他眼睛是红的,想他是滴眼药水了吗?这真是一个完全没有感情的假哭,我直到看到幻儿说他哭,我才意识到原来他是在假哭。

早上听着Dr. Balasey的证词一边哭一边觉得曙光,晚上听着NPR分析全天的听证心里沮丧到极点时,想到能不能disbar这个混蛋呢?他今天这表现对照着Dr. Balasey任何一个律师都会觉得不合理吧?
结果晚上就看到这个!好像又有了一点希望?哪怕他被选进高庭,ABA一样可以disbar他吧?只要Mark Judge被传上庭,分分钟可以水落石出啊!

Disbar 也不能阻止他进入高庭。高庭法官没有任何限制,连年龄和公民资格都不需要。神奇吧。
Mark Judge 出庭未必说真话。

希望这是一个culture moment. 全国多少受过sexual assault, 觉得不够资格报案,出于种种内疚不想声张,求助警方被dismiss 的妇女,在这一刻伤口被揭开,泪流满面。希望她们都会投票。

我幸运的从没受过sexual assault, or violent assault of any kind. 跟几乎所有的妇女一样,都遇到过暴露癖,在公车上的咸猪手。当我在校园里遇到暴露癖的时候,惊魂初定,打电话给清华派出所,他们敷衍的说:你都过了一个钟头打电话来,有什么用啊,下次马上打,我们过来也许能抓住。 第二次我遇见的时候,再打电话,他们继续敷衍,好我们记下来。

这个暴露癖是多次,反复作案的,所有的女生都知道,他经常在黄昏时,在七号楼外小花园打水回来的路上,和水利馆边出现。现在你要问我,我已经完全不记得这是那一年,是夏末还是秋初,只依稀记得三十岁上下,穿一件风衣(方便突然揭开)。 因为每次想起都像吞了一个苍蝇,努力忘记. 只有黄昏那种模糊的光线,面目模糊穿风衣的男人,带来的巨大的不适感.

校园只有这么大,到处人这么多,但是派出所什么都没有做。那时候我居然也不觉得派出所有什么不对,的确很难抓啊,有人报告后再来早就跑了吧。但是现在我想,为什么派出所发通告,疑犯画像,让大家报告什么时候见到可疑人员?他明显年龄比学生大,又穿着辨识度很高的风衣。报案时,警察没有问我的姓名班级,没有派人过来看,甚至说哦这个事情我们早知道了。同班同级的女生都遇到过五六次,其中好几个女生打电话报警。警方甚至没有发通告要求遇到此事的女生打电话报告时间地点,梳理数据,在可能的地方加强警力。

这就是为什么许多受害人不报案,没有把握能够捉到罪犯,定罪, 而自己要反复relive 创伤性的回忆.

假设我深深记住那人的脸,现在突然看到了他出现在电视上,出来指认,会是什么样的反应呢?你为什么当时不报案? 你怎么会连哪年哪月都记不清?你说打电话给校派出所报案了,为什么他们没档案? 你为什么不留名字?即使有你报案的档案,当时的描述为什么 如此模糊,没有任何特征对应XX? etc. etc etc.

在一个没有完美执法机构和完美法律系统来保护受害人的社会里, 要求女性做一个完美的受害者: 要么别开口,开口就必须得能完美的证明对方有罪. 这就是父权社会给女性的两个选择:一个是坏的.另一个是更坏的.

如果你没有意识到这个状况错在哪里,你就是父权社会的受害人。

是,刚去查了高庭FAQ.虽然说不需要毕业于法学院,但是没有说要不要bar? 当然GOP直接抓个 KKK上高庭也不是不可能的。 Don McGahn从就任FEC时就致力从内部拉垮各种institution. 这也很符合Koch爪牙的做派。整个GoP都是致力于毁掉美国现存的秩序的。真的是美国式的文化大革命啊!founding father们是怎么想的?这么千疮百孔的社会机器居然挺过了两百年,也是很惊人了。

还有那些把 innocent until proved guilty 挂在嘴上质疑Dr Ford 没有证据的共和党议员..innocent until proved guilty 是刑事审判的标准. 现在是Job interview. 决定选择此人进入高庭。这是innocent unless proved guilty immediately


想一想,如果你给孩子雇保姆, 有个前任雇主说保姆疑似偷东西,保姆说没有的事儿. 你会怎么做呢?
1. 质问前雇主要求他拿出照片证据人证不然别信口开河乱喷并义愤的马上雇佣这个保姆表示支持
2. 礼貌的感谢前任雇主提供信息, 请保姆提供几个其他前任雇主了解情况.
3. 出于谨慎面试跳过此保姆开始面试下一个.

显然正常做法是2. 民主党要求的也是2。

1 完全不正常. 尤其是这个保姆将是终身制, 永远不能换人. innocent unless proved guilty immediately 标准显然不适用.

3 显得有些过度谨慎, 除非你觉得前任雇主非常可信,

前任雇主并没有起诉此人,没有义务提供各种证据, 她只是在你选择新雇员的时候来提供了你可能会想知道的信息. 你看得也是她的言行背景的可信度。

这不是扯淡么?Innocent until proven guilty 是犯罪庭审的标准,不是其他法律事件的标准,连民事官司的标准都不是,更别说共和党的听证会了。

在犯罪庭审的情况下,原告是代表人民的政府检察官,他们会提出所有证据呈堂,并且叫来所有相关的证人作证。同学 Mark Judge 呢?其他控告者受害者呢?怎么不敢叫出来对质一下?在上庭之前还要进行调查,进行过了吗?判决有罪无罪的是被告的 12 个 peers 组成的陪审团,这里判决的是谁?51个共和党参议员,他们从头到尾都没兴趣查出真相。被判无罪的被告是当庭释放不是捧进最高法院当终生大法官。

所以在这个事件里,如果你跟我说什么 innocent until proven guilty,就是或蠢或坏或又蠢又坏,如果还是女的,你就是又蠢又坏而且还犯贱。

好多人说 Ford 看上去像是真的,连我都相信了,但是我仍然支持 Kavannaugh 。嗯,别装了,你的意思就是,I don't care that women are assaulted. It doesn't matter. Women are worthless and their dignity and rights means shit to me.

That's OK. 世界上大多数的人都是这样的立场,女性就是比男性低一等。如果计算上纵向的历史长河,这个立场简直就是压倒性绝大多数。恭喜你,你是大多数那一拨的。两性平等,平等权利,这才是少数。Let's not kid ourselves. 少数的立场才需要斗争来争取,随大流是最轻松的。

为什么强奸女性是犯罪?是一件坏事?不是因为女性的贞操有多么重要多么 precious 需要保护,而是因为一个女人不愿意跟一个男人发生肉体关系,但是这个男人践踏了她的意愿,也就是说,她没有权利执行自己的意愿,他的意愿更高而她不配有个人意愿。如果一个女人不愿意被某些人摸屁股呢?如果一个女人想得到平等的工作机会和工资呢?如果一个女人怀孕了不想生孩子呢?都是一样的道理。没有社会人有绝对的权利或权力,但是一个女人有没有权力象一个男人一样执行自己的意愿?她的权利和权力是否一样多?

不能不回想起当年 Rodney King 事件,四个白人警察殴涌着打倒在地上的黑人男的录像放出来给大家看,我先是惊呆了“理想国”的执法现实,再是惊呆了群众与媒体喉舌面对黑白分明的画面各种借口推搪都冒出来了,“他挣扎了”,“他嗑药了”,“他有犯罪历史”,等等等等,人怎么可以这样?四个警察在本地的审判里被无罪释放。近三十年后,更多的录像视频放出来,黑人男青年被警察掐死,中几十枪打死,大家还是无所谓,警察甚至连起诉都没有。这跟对于女性的做法有什么两样?白人妇女还觉得自己不是 Anita Hill 而是迪士尼公主吗?在权力的眼中,白人妇女跟 n***er 有差别吗?

有什么用吗?比如有Judge的证词,但是没有实际的物证?比如Kavanaugh测谎通不过?该投票还是一样的投?

好紧张。报道这个的记者说,我现在讲这些谁跟谁说话,谁进谁出,脸色眼神,你们可能觉得很无聊。可是当初Obamacare repeal被击败就是在这种情形下发生的!原来投票时间是东部下午一点半,结果时间到了,人不见了,大家围着Flake在后面吵。一直到一点五十才出来说话。
早上Flake表态要投赞同票以后在电梯里被那两个姑娘堵在门口声泪俱下控诉,推上看文字没有啥感觉,都麻木了。但是NPR里听到音轨,恸哭!当时就想。这个Flake听到这样的控诉还能投得下去赞成票,这心里得有多黑啊!居然还有点良心!太惊讶了!

Mark Judge 说他同意跟警方合作,如果他的证词保密 ... :shock: :doh: :whistling:

如果 Mark Judge 承认自己在场并且目睹 Kavanaugh 的强暴不遂行为,证词应该会写到报告里给参议院的法律委员会看,所以民主党议员多半会看见,这时如果再投票恐怕就无法保密了。

Lisa Murkowski 不是委员会成员,她口头表示支持 Flake,如果没有 FBI 调查就不投同意票。

据说Murkowski当选很大一部分选票来自阿拉斯加的印第安女性?她们非常关注这个事件,所以她算是比较可靠的反对者。但是就算FBI的调查结果依然不能改变最终选票结果,对中期选举的选民来说至少多了一些数据点,少一点“he says she says"的中间摇摆的依靠。。。

Senator Susan Collins' "district" is the entire state of Maine. She is a senator not a congresswoman. So a huge contract wouldn't have (much of) an effect.

说实话前几天我就看见有人说,GW Bush 跟 Kavanaugh 完全是一路人,privileged upbringing, prep school, ivy league college, and frat boy through and through. 上大学时喝酒鬼魂还吸 cocaine,非常糜烂。Kavanaugh 的黑历史都藏在他给 GW Bush 白宫做的事情和文件里,现在的共和党议员死命藏着不给人看,即使是同在 judiciary committee 的民主党议员也看不到。不知道他给小布什做了什么事儿,估计绝对不止是提供法律支持 torture 那么小的事情,因为美国民众基本上不介意甚至支持 torture 外国人,管你是无辜还是有罪呢。他给小布什干过的事情连共和党议员都知道是见不得人的。说实话我的想象力没那么丰富,想不出还能坏成什么样。

布什和 Kavanaugh 都是极其典型的 white male privilege 例子,随便做什么都没关系,一样飞黄腾达。What does a rich white boy have to do to get punished for anything? 不仅不惩罚还被嘉奖呢,还有无数人追捧呵护呢。It must be nice, it must be nice, to have Washington on your side ...

男孩子能跟frat boys混,家长与有荣焉。女孩子就不知道了,估计混得好(嫁人)就鸡犬升天,混不好则自认倒霉?

前两天看得这片讲耶鲁这个臭名昭著的兄弟会。里面就提到大小布什都是会员

说到美国大学里的 frat boys,我颇好奇望子成龙望女成凤的华人家长们想象自己的娃考进了常春藤之后打算怎么跟校园里这些白人男同学混在一起。
这是我相当好奇的一个点,拼数学拼象棋的娃进了那几家藤校如何和这些截然不同背景的男同学混呢?

今年朋友的侄女坚持去了USC而不是父母希望的藤校,多好啊,USC多数是亚裔,天气好,吃得也好,时髦奶茶店好多家,谁要去冻死人的地方! :fish002:

华川粉最爱说自己的儿子将来也可能受到诬告,所以要捍卫Kavanaugh 的清白。完全是臆想症的表现,把自己当成白人了,居然把Kavanaugh代入儿子的角色。这种崇尚Male Masculinity 的RAPE culture 里, 亚裔男生往往被鄙视为缺乏男性征服力,其实是这种文化的受害者。做父母的也不知道自己到底在捍卫什么。

再说,按照他们的美好设想,取消了AA就能进藤校的华人子弟,一时是不可能被共和党提名做大法官的,川粉们真是多虑了。

捍什么卫?清什么白!看到 NYT 一读者评论说:36年前往事确实可能说明不了什么问题,但是他在听证会上的表现说明他就是那种会强暴女性的人!深得我心。

这些人也太土了。在美国生活多年,却一点不知道身处的文化以及自己最向往的顶层阶级是啥东西,这得多封闭才能做到啊。
